Legal Protection Order in Pakistan by Family Court for Female
- The Punjab Government has published a new law by the name of the Punjab Protection of Women Against Violence Act, 2016, through which females can obtain a legal protection order in Pakistan through the Family Courts.
- Many laws have been passed by the Punjab Government in favor of females against domestic violence in the country. If a wife is a victim of domestic violence, she can obtain a legal protection order in Pakistan through the Family Court with the assistance of a lawyer.
Below is the list of legal protection orders that a female can avail from the court.
- No Communication
When a wife files a complaint against her husband, the court can order the husband not to communicate with the wife, with or without exceptions.
- Stay Away from Wife
The court can also issue a legal protection order against the husband directing him to stay away from the wife, with or without exceptions.
- Stay at a Distance
The Family Court can also pass an order directing the husband to stay at such a distance from the wife as the court considers necessary.
- Wear GPS Tracker
For the protection of the wife against the husband, the court can also order the husband to wear a GPS tracker on his wrist or ankle. The husband will be bound to wear this GPS tracker; otherwise, he may be sent to jail.
- Move Out of House
The court can also order the husband to move out of the house.
If the court believes that there is a possibility of grave violence between the parties and that the life of the wife is in danger, it can order the husband not to enter the house as a legal protection order in Pakistan by the Family Court for a female.
- Stay Order Against Violence
The Family Court can issue a stay order against the husband, restraining him from committing any act of violence and also restraining him from aiding or abetting any act of violence against the wife.
- Stopping Him from Entering the Place of Employment
If the Family Court considers it necessary, it can also order the husband not to enter a place of employment where the wife works.
- Interim Orders
Instead of deciding the case on merits, which may take a considerable amount of time, the court can also pass an interim order in favor of the wife.
This interim order can be any of the orders mentioned above.
- Right to Reside in House
The court can also order that the wife has the right to reside in the house.
If she is wrongfully evicted from the house, the court can restore her right of residence in that house.
