How to End Nikah Legally in Pakistan While Living Abroad
- You can legally end the Nikah in Pakistan while living abroad by hiring the services of a divorce lawyer in the country. Lawyers are legally licensed to represent clients while they are not in the country.
- Not only in Pakistan but all over the world, lawyers are the ones who can legally represent clients in the courts.
If a person is residing abroad and wants to process a divorce in Pakistan, he has to hire the services of a divorce lawyer. In order to appoint a divorce lawyer, he has to send a Special Power of Attorney to the lawyer and authorize him to file the case and conduct the divorce proceedings on his behalf while he is not in the country.
Who Will Prepare the Special Power of Attorney?
- When you have hired the services of a lawyer and paid for the legal services, the first thing the lawyer will do is draft the Special Power of Attorney and email this document to you.
- All you need to do is download the document from your email, sign it, and get it attested by the Pakistani Embassy or Consulate in the country where you are currently residing. After attestation, you must send the original document to the lawyer by courier.
If the Wife Needs Khula
- Khula is the divorce initiated by the wife. If the wife is residing abroad and cannot come to Pakistan, then she can hire the services of a divorce lawyer.
- In order to hire the services of a lawyer, the wife will also have to appoint a lawyer through a Special Power of Attorney.
- When the wife wants to initiate the Khula procedure in Pakistan, she will contact a lawyer and provide all the necessary details and documents. After payment, the lawyer will draft the Special Power of Attorney and email the document to the wife.
- The wife will then have to download the document, sign it, and get it attested by the Pakistani Embassy or Consulate in the country where she is residing. Once it is attested, she will also have to courier the original document to the lawyer.
What Authorities Can Be Given to the Lawyer?
- The lawyer can be given any authority mentioned in the Special Power of Attorney. The lawyer cannot go beyond any authority that is not mentioned in the Special Power of Attorney.
- Other than the divorce proceedings, you can also authorize the divorce lawyer to perform certain other tasks through the Special Power of Attorney document.
- You can authorize the lawyer to obtain the Divorce Certificate in Pakistan on your behalf. You can also authorize the divorce lawyer to get documents attested by the Ministry of Foreign Affairs in Pakistan.
- You can authorize your lawyer for anything relating to the divorce proceedings or any other matter mentioned in the Special Power of Attorney.
When Does the Nikah Come to an End?
- The Nikah legally comes to an end while living abroad only when the Divorce Certificate is issued to the client.
- Anything prior to the issuance of the Divorce Certificate will be considered part of the divorce proceedings, but it will not be considered the finalization of the divorce.
- Even when a female obtains a Khula decree from the Family Court through a lawyer, she must also obtain the Divorce Certificate after the period of Iddat, which is 90 days.
- A female residing abroad can also authorize her attorney through the Special Power of Attorney to obtain the Divorce Certificate on her behalf.
