According to the Muslim family law ordinance, a wife needs specific grounds, which she has to prove before the court through a lawyer in order to obtain a decree for dissolution of marriage in Pakistan.
Below are the grounds of khula in Pakistan provided by law:
IDDAT PERIOD AFTER KHULA
After the complete khula process in Pakistan, when the wife is issued the court decree, the iddat period of the wife starts.
This iddat period is the waiting period of 90 days for the wife.
During this iddat period, she has the option to reconcile with the husband.
After the expiry of the iddat period, the talaq in Pakistan will be finalized, and the final certificate will be issued.
The khula procedure in Pakistan by overseas Pakistanis is a bit different from the regular khula process in Pakistan.
When a female wants to initiate the khula procedure in Pakistan from abroad, she has to go through the following steps:
DIVORCE PROCEDURE IN PAKISTAN: If a male in Pakistan wants to give divorce to his wife, then he will have to adopt the following divorce procedure in Pakistan:
Draft a Divorce Deed: He has to draft a divorce deed, either personally or through a lawyer.
Send a Copy to the Wife: He will post a copy of this deed to the wife and submit the original to the Union Council.
Notices by the Union Council: The Union Council will send notices to both the husband and the wife to appear in person before it.
Family Members for Reconciliation: The Council will also ask both the husband and the wife to bring at least two male family members from both sides to facilitate reconciliation between them.
Reconciliation Period: The reconciliation effort will continue for at least 90 days. There is no maximum limit provided in family law, due to which it is often misused.
If Reconciliation Succeeds: If reconciliation succeeds, both the husband and the wife can rejoin.
If Reconciliation Fails: If reconciliation fails, then the divorce certificate in Pakistan will be issued.

PLD 1964 Kar. 306 State v.s Mst. Tauqir Fatima In this case it was decided by the court that mere oral pronouncement of talaq or signing and private divorce deed without following the divorce procedure under section 7 of MFLO 1961 does not dissolves the marriage for civil purposes.
PLD 1989 Kar. 513 Muhammad Salahuddin v. Mst. Rukhsana In this case the court decided that the husband has the right to change his mind within the period of 90 days after the divorce. The husband can revoke the divorce anytime.
PLD 1959 Lah 566 Bilqis Fatima v. Najm-ul-Ikram Qureshi In this case law the high court decided that court has the power to dissolve the marriage if it finds out that the wife cannot live within the limits ordained by Allah Almighty.
PLD 1967 SC 9 Mst. Khurshid Bibi v. Baboo Muhammad Amin In this case the Supreme court decided that the husband’s consent is not required by the wife or by the court to grant the khula
Below is the difference between the Khula and divorce
DOWER AMOUNT IN CASE OF DIVORCE BY HUSBAND: When the male gives divorce to the wife he has to give the dower amount to the wife as decided at the time of marriage and as mentioned in the nikahnama
DOWER AMOUNT IN CASE OF KHULA BY WIFE: If the wife obtain khula from the husband she has to surrender all or partial dower amount lieu of her khula as decided by the court. If she has already received the dower amount then she has to return all or partial dower amount as ordered by the family court

The dowry articles is the right of the wife. All the gifts given by the bride or her family or friends to the groom or his family will be considered as dowry articles in Pakistan
IN CASE OF DIVORCE: In case of divorce the wife can claim the dowry articles from the family court. She can also claim these articles before the divorce from husband

After the divorce from husband when the 90 days reconciliation period is expires the government issues the divorce certificate to the husband and after the khula decre from the family court also there is a 90 days reconciliation period after which this divorce certificate in Pakistan is issued. Once the divorce certificate is issued, both the male and the female can update their marital status in Nadra. They have to take this divorce certificate to the Nadra office to update their marital status from married to divorcee or they can also update their marital status through Nadra Pak ID app.
